

If counsel is going to be late for a hearing, counsel must make a reasonable effort to notify the Judge or Magistrate as soon as practical in order to explain the reason for their lateness. If counsel is not present in Court at the assigned hearing time, the case may commence without counsel, may be continued, or may be dismissed, as the Court may decide is appropriate.

Rule X.XX.”ġ.05 These Rules shall be effective May 1, 2003, and supersede all previous rules promulgated by this Court.Ģ.01 Counsel for all parties shall be present and before the Court at the assigned hearing time. They shall apply to proceedings pending at the time they take effect.ġ.04 These Rules shall be cited as “Marion F.C. In their application, they shall be construed so as to provide fairness and to secure just, expeditious, and inexpensive determination of all proceedings. The Court may amend these Rules from time to time as needed or as required by law.ġ.02 These Rules are intended to supplement and compliment the Ohio Rules of Civil Procedure, the Ohio Juvenile Rules of Procedure, the Superintendence Rules of the Supreme Court of Ohio, and other controlling statutes.ġ.03 These Rules shall be applied, construed and enforced so as to avoid inconsistency with other rules of Court and statutes governing proceedings of this Court. 1.01 The Family Division of the Court of Common Pleas for Marion County, Ohio adopts the following Rules for the management of proceedings and other functions of the Court pursuant to Rule 9 of the Rules of Superintendence of the Common Pleas Courts.
